Terms of Service

1. Agreement to terms

These Terms of Service (“Terms”) govern your access to and use of Perch (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are entering into these Terms on behalf of a company, you represent that you have authority to bind that company.

2. The Service

Perch lets operators and agencies generate AI-assisted landing pages, capture and attribute leads, and manage a lightweight CRM and client portal. Perch is intentionally not a drag-and-drop page builder; pages are structured content rendered by a fixed renderer. Features and limits may change as the Service evolves, particularly during the private beta.

3. Private beta

The Service is currently offered as a private beta. It is provided on an as-available basis, may contain defects, and may change or be discontinued. There is no billing during the beta. We will give reasonable notice before introducing paid plans.

4. Your account

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorized use. You must provide accurate information and keep it up to date.

5. Your content and lead data

You retain ownership of the content you create and the lead and contact data you collect through the Service (“Your Content”). You grant us a limited license to host, process, and display Your Content solely to provide the Service. You are responsible for Your Content, for obtaining any necessary consents from the individuals whose information you collect, and for complying with applicable privacy and marketing laws. Our handling of personal information is described in our Privacy Policy.

6. Acceptable use

You agree not to use the Service to:

• violate any law or third-party right;
• send unsolicited communications or collect data without proper consent;
• publish misleading, fraudulent, or deceptive offers or pages;
• interfere with, probe, or attempt to gain unauthorized access to the Service or its infrastructure.

7. AI-generated content

The Service uses AI to help generate page content. AI output may be inaccurate or unsuitable, and you are responsible for reviewing, editing, and approving any generated content before you publish or rely on it.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends; we will handle your data in accordance with our Privacy Policy.

9. Disclaimers and limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, Perch will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the Service.

10. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above and, where appropriate, by additional notice. Continued use of the Service after changes take effect constitutes acceptance.
